Child custody and contact in Türkiye: the child’s best interests, interim arrangements, parental agreements and care needs.

The child’s best interests

Custody is not awarded to punish either parent. The child’s age, continuity of care, health, education, relationships with the parents and actual living conditions are considered together. A sufficiently mature child’s views may also be relevant.

Arrangements during proceedings

Interim custody and contact arrangements may be made while divorce proceedings are pending. The practical care arrangements, school and health information, and the child’s current circumstances help establish what is needed.

Contact with the other parent

Contact arrangements concern the child’s relationship with the parent who does not exercise custody. A clear schedule should take the child’s needs and practical circumstances into account. A parental agreement remains subject to review in light of the child’s interests.

Changes and financial support

An existing custody arrangement is considered in light of subsequent circumstances and the child’s interests. Custody and child maintenance are related but distinct issues; financial support is not interchangeable with contact. Arrange a meeting with the relevant orders and records.
