Different types of maintenance
Interim maintenance addresses support needs during proceedings. Post-divorce spousal maintenance and child maintenance have different purposes and legal conditions. The type of claim must be identified before its requirements and amount can be considered.
Needs and ability to pay
Income, recurring expenses, the child’s needs and the parties’ actual financial circumstances are relevant. Monthly expenses, annual costs and one-off payments should be distinguished. A requested amount should be supported by the circumstances and records.
Changes to an existing payment
A maintenance increase is not determined by a preferred figure alone. The existing order, its date and terms, changes in needs and financial circumstances, and supporting evidence should be examined together.
Orders, payments and evidence
Bring the judgment or agreement establishing the payment and available payment and expense records. The type of maintenance, the terms of the order and the dates matter when considering payment, changes or enforcement. Divorce and custody may raise related questions.
